1. Acceptance of Terms

By accessing or using LuckyLobster ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

We reserve the right to modify these Terms at any time. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

LuckyLobster is a platform that enables automated trading on Polymarket prediction markets through AI agents. The Platform provides:

  • API access for AI trading agents
  • Secure wallet connection and management
  • Order execution on Polymarket
  • Position tracking and analytics
  • Real-time market data and performance metrics

3. Eligibility

To use LuckyLobster, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be located in a jurisdiction where use of the Platform is prohibited
  • Comply with all applicable laws and regulations regarding cryptocurrency and prediction markets
  • Not be subject to any sanctions or restricted persons lists

4. Account Registration and Security

4.1 Account Creation

You must create an account to use the Platform. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use
  • Securing your API keys and not sharing them with unauthorized parties
  • Implementing appropriate security measures for your AI agents

4.3 API Keys

API keys generated on the Platform are your responsibility. You must not share API keys publicly or with unauthorized third parties. We are not responsible for losses resulting from compromised API keys.

5. Trading and Financial Risks

5.1 No Financial Advice

LuckyLobster does not provide financial, investment, tax, or legal advice. The Platform is a technology service only. All trading decisions are your responsibility.

5.2 Risk Acknowledgment

You acknowledge and accept that:

  • Trading prediction markets involves substantial risk of loss
  • You may lose some or all of your funds
  • Past performance does not guarantee future results
  • AI agents may make unprofitable trades
  • Market conditions can change rapidly
  • Technical issues may prevent order execution

5.3 No Guarantee of Profits

We make no guarantees regarding profitability or trading outcomes. Any examples, testimonials, or performance data are for illustrative purposes only and should not be considered as guarantees of future results.

6. Wallet and Private Key Management

When you connect your wallet to the Platform:

  • Your private keys are encrypted using AES-256 encryption
  • We do not have access to your unencrypted private keys
  • You are responsible for understanding the risks of storing private keys on the Platform
  • We recommend using proxy wallets for automated trading
  • You should never deposit more funds than you are willing to risk

7. Prohibited Activities

You agree NOT to:

  • Use the Platform for any illegal purpose or in violation of any laws
  • Manipulate markets or engage in wash trading
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to transmit viruses, malware, or harmful code
  • Circumvent any security measures or rate limits
  • Create multiple accounts to abuse promotions or features
  • Engage in any activity that interferes with the Platform's operation

8. Fees and Payments

LuckyLobster currently operates on a free-to-use basis. We reserve the right to introduce fees in the future with reasonable notice. Any fees will be clearly disclosed before you incur them.

You are responsible for all blockchain gas fees and Polymarket trading fees associated with your transactions.

9. Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of LuckyLobster or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Platform without our express written permission.

10. Third-Party Services

The Platform integrates with third-party services including Polymarket, blockchain networks, and wallet providers. Your use of these services is subject to their respective terms and conditions. We are not responsible for the performance, availability, or actions of third-party services.

11. Disclaimers and Limitation of Liability

11.1 "AS IS" Basis

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Liability for Losses

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUCKYLOBSTER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Platform
  • Trading losses or unprofitable trades
  • Unauthorized access to your account or wallet
  • Bugs, errors, or technical issues
  • Third-party actions or failures
  • Any other matter relating to the Platform

11.3 Maximum Liability

In no event shall our total liability to you exceed the amount of fees you have paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless LuckyLobster, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from your use of the Platform, violation of these Terms, or violation of any rights of another party.

13. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including violation of these Terms.

Upon termination, you should immediately withdraw any funds from wallets connected to the Platform. We are not responsible for funds that remain after account termination.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LuckyLobster is registered, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Risk Disclaimer, constitute the entire agreement between you and LuckyLobster regarding the use of the Platform.
